TERMS & CONDITIONS

General

  2. Email is to be used as the principal means of communication.
  3. On receipt of an order, Arte di Pelle Ltd (ADP) will send the buyer a confirmation email confirming all details of the purchase.
  4. A contract only exists when this email is sent by ADP to the buyer (whether it is received or not). This email constitutes an acceptance by ADP of your offer to buy goods from ADP.
  5. The buyer is advised to check the details of the confirmation email to ensure all are correct. They are also advised to print a copy for reference.
  6. The buyer undertakes to ensure that all details they provide are correct when purchasing the products from this website.

    The buyer must also ensures that the credit or debit card used to pay for the goods is their own & that there are sufficient funds to cover the goods purchased.

  7. The buy agrees to inform ADP of any changes to their details as soon as possible.
  8. The buyer can cancel their order any time prior to their order being processed up to receipt of the confirmation email by emailing us on lawrence@artedipelle.com or calling on 01252 795706.
  9. The buyer may also withdraw from the contract after receipt of the confirmation email by:
    1. Sending notice of cancellation by email to …. Ensuring you quote your name, address & order reference number or
    2. When you have already received the goods by returning them undamaged & unused within 14 days of the purchase date.
  10. Once ADP receives confirmation of the buyers wish to withdraw from the contract, any sum of money debited to ADP in relation to the contract will be re-credited in full ASAP and in any event no longer than 30 days after the order date provided the goods are returned to ADP unworn, undamaged & within 14 day of purchase.
     

Liability

 

  1. This Liability section applies only to the extent permitted by law. For the avoidance of doubt, ADP do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from ADP’s negligence or wilful default, or that of ADP’s employees, agents or subcontractors or (b) fraudulent misrepresentation.
  2. ADP does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.
  3. ADP will do its best to correct errors and omissions as quickly as practicable after being notified of them.
  4. TO THE FULLEST EXTENT PERMITTED BY LAW, ADP IS PROVIDING THIS WEB-SITE AND ITS CONTENTS ON AN “AS IS” BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS WEB-SITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THIS SITE INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, ADP DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS WEB-SITE IS ACCURATE, COMPLETE OR CURRENT.
  5. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, ADP shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify ADP of the problem. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
  6. ADP do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the ADP web-site or for any products or services purchased from ADP.
  7. ADP will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim.

Processing of orders

 

  1. Credit & debit cards are debited on despatch of your order. Prices include all sales taxes (where applicable) unless otherwise stated.
  2. All purchases are deemed as made in the United Kingdom. United Kingdom law shall govern every aspect of the contract between ADP & the buyer on this website.
  3. ADP endeavours to ensure that all shipments are made with one working days of the purchase order date to United Kingdom & worldwide destinations.
    However, some styles may take up to 28 days to deliver if there is a stock problem. The buyer will be informed by ADP operator in this case.
  4. The ADP Standard returns policy applies to all purchases from ADP.

Delivery

 

  1. The period stated to receive the order is approximate. The order will be sent to the address given by the buyer in the order & stated in the confirmation email.
  2. The buyers order may be sent in instalments.
  3. Title to the goods ordered will pass to the buyer once ADP has received payment in full from the buyer.
  4. If the delivery address is outside the UK then you may be subject to import duties, taxes & customs charges. Any such charges must be borne by the buyer.
    ADP recommends that the buyer contacts their local customs office for further information.
  5. If the delivery address is outside the UK it is possible that the local customs will open parcels to check contents. This is outside of ADP’s control.


Miscellaneous

  1. It is a crime to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. ADP tracks the electronic ‘fingerprints’ of every order placed on ADP to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our web-site.
  2. ADP may amend these terms and conditions from time to time, and place the new version on the web-site. When ADP do so, ADP will mention the fact on our home page (www.wherefashion.co.uk). All purchases from the date that the amended terms are placed on our web-site onwards will be governed by those new terms.
  3. These terms and conditions shall apply when ADP accepts your order by e-mail confirming that it has been received. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between ADP and you relating to your purchase. ADP advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by ADP.
  4. You are advised to read (and are responsible for reading) all information on this web-site fully.
  5. If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain.
  6. These terms and conditions are subject to the laws and exclusive jurisdiction of the United Kingdom.
